Top Democrat Rep. Adam Schiff on Sunday refused to rule out the possibility of defying a subpoena from Congress if the new House Republican majority calls him to testify next year.

Schiff said he would have to “consider the legality” of any such order – despite being quick to criticize others who previously resisted his January 6 committee subpoenas.

The California Democrat has been a top political scalp for Republicans following his key role in the impeachment of Donald Trump and the former president’s investigation as a member of the select committee probing the US Capitol riot.

‘We have to consider the legality of the summons. But I certainly would look at our obligation, the administration’s obligation, to follow the law,’ Schiff told CNN’s State of the Union.

‘And the fact that he disrespected the law doesn’t set a precedent, I hope it’s widely followed,’ he said as a shot in the aisle.

‘But we have to look at the legality or lack of legality of what they do,’ Schiff said.

Current House GOP leader Kevin McCarthy, who is expected to move to the speakership next year, has pledged to strip Schiff of his committee assignments.

In the current Democrat-majority Congress, Schiff chairs the powerful House Intelligence Committee.

The lawmaker hit back on Sunday, claiming McCarthy’s plan for Gavel would revolve exclusively around the former president’s will and ignore “the gradual abuse of power by Donald Trump.”

‘They’ll say what they have to do with Donald Trump.’

He also lashed out at McCarthy’s plan to subvert the committee’s assignments on the Trump-Russia investigation.

Schiff said, “McCarthy clearly doesn’t think it’s collusion if your campaign manager is giving Russian intelligence agents inside polling data and war strategy in key states while the Russians are helping your campaign, but Most Americans would call it collusion.” ,

He added that McCarthy’s “problem” would be the slim majority of his caucus – meaning he would need to work with more extreme lawmakers such as Rep. Marjorie Taylor Greene and Paul Gosar to pass GOP agenda items.

Schiff said, ‘Whatever they say, they will do.’ ‘And, right now, they’re asking to remove me from our committees. And he is ready to do it. He is ready to do whatever they ask.

Schiff accused McCarthy of having no “ideology” of his own beyond a desire to gain power.

‘They have no core set of beliefs. Not only is it very difficult to reach 218 this way. 218 is even more difficult to maintain. It’s his problem,’ Schiff said.

‘So, that would be misrepresenting my record. He will misrepresent Eric Swalwell or Ilhan Omar, whatever it takes to get the votes of the QAnon caucus within his convention.’

Swalwell and Omar are also targeted with McCarthy’s threats to remove the committee.

Democrats voted for Gosar and Green to do the same while they had a majority — Gosar for sharing a video attacking another member of Congress, and Green and Capitol Hill for extremist comments. Before leaving asked to promote violence.
